1) Scope of Application
1.1 These Terms of Service (hereinafter referred to as “Terms”) of MMM Culture UG, Grünauer Straße 201–209, 12557 Berlin, Germany (hereinafter referred to as “Seller”), apply to all contracts for the sale and delivery of goods concluded between a consumer or entrepreneur (hereinafter referred to as “Customer”) and the Seller through the Seller’s online shop. The inclusion of the Customer’s own terms is hereby rejected unless otherwise agreed in writing.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.3 An entrepreneur is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their commercial or independent professional activity.
2) Conclusion of Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers by the Seller, but serve to enable the Customer to submit a binding offer.
2.2 The Customer may submit the offer via the online order form integrated into the Seller’s online shop. By clicking the button that completes the order process, the Customer submits a legally binding offer with respect to the goods contained in the shopping cart.
2.3 The Seller may accept the Customer’s offer within five (5) days by:
- sending an order confirmation by email or in writing (the date of receipt is decisive), or
- delivering the ordered goods to the Customer (the date of receipt is decisive), or
- requesting payment from the Customer after the order has been placed.
2.4 The contract text will be stored by the Seller and sent to the Customer after submission of the order in text form (e.g., email). Customers with a user account can view their past orders after logging in.
2.5 The Customer can identify input errors by carefully reviewing the information displayed during checkout and correct them using the standard browser and input functions until submitting the order.
2.6 The contractual languages available are German and English.
2.7 Order processing and communication generally occur by email. The Customer must ensure that the provided email address is accurate and that emails from the Seller can be received.
3) Right of Withdrawal
3.1 Consumers residing within the European Union (EU) have a statutory right of withdrawal in accordance with EU law. Detailed information is provided in the Seller’s separate Return & Withdrawal Policy.
3.2 For Customers outside the European Union (Non-EU countries), all international sales are final. No refunds or exchanges will be issued unless the Customer received the wrong item or a defective product. In such cases, the Customer must contact the Seller at support@delopostia.com and the Seller will arrange an appropriate solution.
4) Prices and Payment Conditions
4.1 All prices listed in the online shop include the applicable VAT for EU Customers. Any additional shipping costs will be displayed separately during checkout.
4.2 For deliveries to countries outside the European Union, additional charges such as customs duties, import taxes, or other local fees may apply, which are not covered by the Seller and must be borne by the Customer. These fees are determined by the local customs authority and are the sole responsibility of the Customer.
4.3 If an order is refused, unclaimed, or returned due to unpaid customs fees or import restrictions, the shipment may be destroyed or returned at the Customer’s expense. In such cases, no refund will be issued, as the goods have already left our warehouse and cannot be resold.
4.4 Available payment methods are displayed in the Seller’s online shop. Payment is due immediately upon order confirmation, unless otherwise stated.
5) Delivery and Shipping Conditions
5.1 Goods are delivered to the delivery address specified by the Customer unless otherwise agreed.
5.2 If delivery fails for reasons attributable to the Customer (e.g., incorrect address, refusal of receipt), the Customer bears the resulting reasonable costs. This does not apply if the Customer legitimately exercises their right of withdrawal.
5.3 Deliveries within the European Union (EU)
For orders shipped within the European Union, the risk of loss or damage to the goods passes to the Customer only upon delivery to the Customer. Until that point, we remain responsible for any damage or loss during transport in accordance with applicable consumer protection laws.
5.4 Deliveries outside the European Union (Non-EU Countries)
For all deliveries outside the European Union — including but not limited to Switzerland, the United Kingdom, the United States, Canada, Brazil, Argentina and other international destinations — the risk of loss or damage passes to the Customer upon handover of the goods to DHL or any other shipping carrier.
We are not liable for any loss, theft, damage, or customs seizure occurring after the parcel has been handed over to the carrier.
Customs duties, import taxes, and other local charges are the sole responsibility of the Customer.
If the Customer refuses to pay customs or import fees, they will bear all resulting costs, including return shipping, processing, and customs handling.
If the goods are destroyed or retained by customs due to non-payment or refusal, no refund will be issued.
Any return costs charged by the carrier may be deducted from any potential goodwill refund.
5.5 Deliveries to High-Risk Destinations
Shipments to destinations with elevated transport or security risk — including but not limited to Afghanistan, Burkina Faso, the Democratic Republic of the Congo, Haiti, Iraq, Israel, Lebanon, Libya, Mali, Somalia (Mogadishu / Hargeisa), Sudan, Syria, Ukraine, Venezuela, and Yemen — are sent entirely at the Customer’s own risk once handed over to DHL.
We are not liable for any loss, theft, confiscation by authorities, or non-delivery in these countries after the parcel has been transferred to the carrier.

5.6 Self-collection of goods is not possible for logistical reasons.

6) Retention of Title
The Seller retains ownership of the goods until full payment has been received.
7) Warranty (Defects Liability)
7.1 The statutory provisions on defects liability apply.
7.2 For EU Customers, defective or incorrectly delivered items will be replaced or refunded as required by law. The Customer must report any visible defects promptly upon receipt of the goods.
7.3 For Non-EU Customers, replacement or refund is only possible if the product received is defective or incorrect. General returns or exchanges are excluded.
8) Vouchers, Discounts & Referrals
Promotional vouchers and discount codes issued by the Seller can only be redeemed within the stated validity period and are not redeemable for cash. Vouchers must be applied before completing checkout.
Referral programs or discount codes may not be abused through self-referrals or fraudulent activity. Any misuse will result in order cancellation and possible payment adjustment.
9) Applicable Law
The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, this choice of law applies only insofar as the granted protection is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
10) Place of Jurisdiction
If the Customer is a merchant, legal entity under public law, or special fund under public law based in Germany, the place of jurisdiction for all disputes arising from this contract shall be the Seller’s registered office in Berlin. The same applies if the Customer is based outside Germany and the contract relates to their commercial or professional activity.
11) Code of Conduct
We adhere to fair trade and transparency principles in line with applicable consumer protection standards.
12) Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR) available at:
https://ec.europa.eu/consumers/odr
We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
